Michele Mayberry provides legal counseling and services relating to the procurement and enforcement of intellectual property rights. Her practice spans several scientific areas within chemistry, biotechnology and the mechanical arts, including cosmetics, food and beverages, medical devices, photosensitive coatings, pharmaceuticals, molecular diagnostics, and laboratory equipment.
Ms. Mayberry's practice includes:
Litigation Counseling, including Conducting Patent Infringement, Validity, Enforceability, and Freedom-to-Operate Analyses
Opinions of Counsel Addressing Infringement, Validity, and Enforceability of U.S. Patents
Preparing, Filing, and Prosecuting Patent Applications in the United States and Abroad
Preparing Applications for Copyright Registration and Preparing, Filing, and Prosecuting Trademark Applications
Ms. Mayberry entered private practice upon graduating from law school. She has represented both plaintiffs and defendants in district court litigation and has experience in litigating medical device and chemical patents, as well as pharmaceutical patents in ANDA litigations. She has experience in all phases of discovery, through and including taking and defending depositions of fact witnesses and identifying and working with scientific experts and economists to support and present case-specific liability and damages theories. She also has experience in claim construction analysis, including preparing Markman briefs, an integral part of patent disputes.
Ms. Mayberry has performed antitrust work in connection with a large chemical company merger and has experience in identifying, investigating, and resolving potential patent infringement situations through patent licensing and negotiation. Ms. Mayberry's litigation experience enhances her ability to render legal advice and provide opinions of counsel in the context of infringement and validity, patent prosecution, and licensing over a variety of scientific disciplines within chemistry, biotechnology, and the mechanical arts.
Prior to law school, Ms. Mayberry obtained a B.S. in Chemistry from George Mason University. She also gained industry experience at a clinical reference laboratory, where she worked as an analytical chemist in the areas of clinical and forensic toxicology. Ms. Mayberry received a J.D. from the George Washington University Law School. While in law school, she was an intra-school semifinalist in the Giles S. Rich Intellectual Property Law Moot Court Competition. She also served as assistant editor for the Food and Drug Law Journal; as a law clerk with the Office of Unfair Import Investigations at the U.S. International Trade Commission; and as an intern to the Hon. Thomas F. Hogan, Chief Judge of the U.S. District Court for the District of Columbia.
Ms. Mayberry is admitted to practice in Virginia and in the District of Columbia and is registered to practice before the U.S. Patent and Trademark Office. She is a member of several professional organizations, including the American Intellectual Property Law Association; the Intellectual Property Section of the Virginia State Bar; the American Bar Association; the American Chemical Society; and the International Union of Pure and Applied Chemistry.
